FNS is merging provisions from three proposed rules - the Child and Adult Care Food Program: Amendments Related to the Healthy, Hunger-Free Kids Act of 2010 rule (0584-AE12); most of the monitoring provisions within the Simplifying Meal Service and Monitoring Requirements in the National School Lunch and School Breakfasts rule (0584-AE67), and the CN Program Integrity Rule (0584-AE08). The merged provisions will be incorporated into a single final rule to be published in Spring 2023 as the CN Program Integrity Final Rule (0584-AE08). Of note, FNS will no longer be pursuing rulemaking as a separate action for 0584-AE12 or 0584-AE67.

The provisions that will be merged from the Simplifying Meal Service and Monitoring Requirements in the National School Lunch and School Breakfasts rule (0584-AE67) and the Child and Adult Care Food Program: Amendments Related to the Healthy, Hunger-Free Kids Act of 2010 rule (0584-AE12) reduce administrative burden for State agencies and School Food Authorities (SFAs), maintain accountability and integrity in the school meal programs, and codifies several provisions of the Healthy, Hunger-Free Kids Act of 2010 (Pub. L. 111-296) that affect management of the Child and Adult Care Food Program. The Child Nutrition Program Integrity rule (0584-AE08) codifies provisions of the Healthy, Hunger-Free Kids Act of 2010 to include establishing criteria for imposing fines against schools, SFAs, or State agencies that fail to correct severe mismanagement of the programs; replaces the renewal application with an annual certification process; and modifies review timing for day care homes and centers in the Child and Adult Care Food Program.
