<RULE_TITLE>Special Areas; State Specific Inventoried Roadless Area Management: Virginia</RULE_TITLE>
<![CDATA[The Governor of Virginia submitted a petition to the Secretary of Agriculture under the provisions of the State Petitions for Inventoried Roadless Area Management, 36 CFR part 294, subpart B (2005 rule), adopted on May 5, 2005. The Secretary accepted the Governor's petition and initiated a proposed rulemaking for the roadless areas in Virginia. This rulemaking would prohibit road construction and reconstruction and timber harvest in certain inventoried roadless areas on the George Washington and Jefferson National Forests. Exceptions to the prohibitions would be allowed for certain health, safety, resource protection, and ecological management needs.

However, on September 20, 2006, the United States District Court for the Northern District of California issued an order setting aside the 2005 rule and reinstating the 2001 Roadless Area Conservation rule (2001 rule). On September 22, 2006, the State of Wyoming filed a motion asking the Wyoming District Court, among other things, to reinstate its order enjoining the 2001 rule. As a result of ongoing litigation, USDA has notified the States that they may consider submitting a new rulemaking petition for roadless area management under the generic petition provisions in the Administrative Procedure Act (5 U.S.C. 553(e)) and Agriculture Department regulation (7 CFR 1.28).]]>
