<p>By this rule, the Department of Commerce (the Department) amends its regulations at 15 CFR Part 20, which address nondiscrimination on the basis of age in programs receiving Federal financial assistance. &nbsp;Specifically, this rule removes from the Department&rsquo;s age-discrimination regulations language that is animated by the theory of disparate-impact liability and targets certain disproportionate effects, rather than intentional discrimination; such language is ambiguous and unnecessary, and it also presents significant legal and policy concerns.&nbsp; The intended effect of this rule is to improve clarity for recipients of Federal financial assistance, and thereby reduce regulatory burden, without diminishing the core statutory prohibition against intentional discrimination on the basis of age.</p>
