<p>The Bureau of Industry and Security (BIS) is publishing this proposed rule to clarify that the scope of the prohibition in section 744.5 of the Export Administration Regulations (EAR) applies to both commodities and software, as well as technology. This clarification reflects the consensus of those United States Government agencies with an interest in export controls related to maritime nuclear propulsion activities. In addition, this rule proposes to clarify the restrictions in section 744.7 of the EAR that apply to certain exports, reexports and transfers (including, but not limited to, in-country transfers) to aircraft, vessels, installations or facilities located in international or foreign territorial waters, foreign seaports or inland ports, foreign airports, or Antarctica.</p>
