<p>Executive Order 13984 of January 19, 2021, Taking Additional Steps To Address the National Emergency With Respect to Significant Malicious Cyber-Enabled Activities, (EO 13984) directs the Secretary of Commerce (Secretary) to propose regulations requiring certain providers and resellers of certain Infrastructure as a Service (IaaS) products to verify the identity of their foreign customers permitting the Secretary, in consultation with Secretary of Defense, the Attorney General, the Secretary of Homeland Security, and the Director of National Intelligence, to grant exemptions to the verification requirement; and authorizing the Secretary to impose special measures on providers with regard to certain foreign jurisdictions or foreign persons. Additionally, Executive Order 14110 of October 30, 2023, Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence&rdquo; (EO 14110) directs the Secretary to impose record keeping requirements on IaaS providers when foreign persons use U.S. IaaS products to train certain large artificial intelligence (AI) models and to require U.S. IaaS providers identify the foreign customers of their foreign resellers. The Department of Commerce is assessing public comments from its January 29, 2024, notice of proposed rulemaking (NPRM) to EOs 13984 and 14110 and will issue a final rule once that review is complete.</p>
