The Department of the Navy is amending its rules to update existing sections relating to the professional conduct of attorneys practicing under the cognizance and supervision of the Judge Advocate General (JAG) for clients with diminished capacity. The rule allows a covered attorney to take preventative action when the attorney reasonably believes that a client has diminished capacity and is at risk of substantial physical harm to himself or herself unless immediate action is taken. Since publishing this interim final rule, the Department of the Navy has decided to revise the entire CFR part. That rulemaking will be pursued under RIN 0703-AA92. The finalization of that rule will also finalize the changes made in the interim final rule. The revisions to this rule will be reported in future status updates as part of DoD's retrospective plan under Executive Order 13563 completed in August 2011.
