<ABSTRACT>

The U.S. Army Corps of Engineers (Corps) ensures compliance with the relevant statutes governing Army Civil Works operation and maintenance of projects that involve the discharge of dredged or fill material into waters of the U.S. The Clean Water Act requires the Corps to seek State water quality certification for discharges of dredged or fill material into waters of the U.S. associated with Corps projects. The Corps proposes revisions to appropriate sections of 33 CFR parts 335 to 338 for Corps projects to ensure consistency with any forthcoming final Environmental Protection Agency (EPA) section 401 water quality certification regulation.
