DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to implement section 884 of the National Defense Authorization Act for Fiscal Year 2016 (Pub. L. 114-92). Section 884 requires the use of source selection criteria that are predominantly based on technical qualifications of the item, and not predominantly based on price to the maximum extend practicable, when procuring an item of personnel protective equipment or a critical safety item if the level of quality or failure of the item could result in death or severe e bodily harm to the user. DoD does not expect this rule to have a significant economic impact on a substantial number of small entities.
