DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to partially implement section 876 of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2017 regarding the preference for the acquisition of commercial construction services. Section 876 expands on section 855 of the NDAA for FY 2016, by adding construction services, and provides for a two-tier approval process for exceptions where a determination can be made that no commercial construction services are suitable. Preference for other commercial services was addressed under DFARS Case 2018-D016 (RIN 0750-AJ79, final rule published August 9, 2019, at 84 FR 39203).
