DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to implement section 809(c) of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2017 and section 815(a) of the NDAA for FY 2012. Both sections address deferred ordering of technical data. Specifically, section 809(c) amends 10 U.S.C. 2320(b)(9), redesignated as 10 U.S.C. 3772(a)(9), and provides that DoD has until 6 years after DoD accepts the last item (other than technical data) under a contract or until 6 years after the date of contract termination, whichever is later, to require a contractor to deliver technical data generated in the performance of a contract. Section 815(a) amends 10 U.S.C. 2320, redesignated as 10 U.S.C. 3772(b), and provides criteria for deferred ordering of technical data.
