DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement to implement section 1662 of the National Defense Authorization Act for Fiscal Year 2021. Section 1662 prohibits the award or renewal of a contract with an entity than engages in commercial terrestrial operations using the 1525-megahertz band or the 1626.5-1660.5 megahertz band, unless the Secretary of Defense has certified to the congressional defense committees that such operations do not cause harmful interference to DoD Global Positioning System devices. The annualized costs associated with this rule are estimated to be de minimis for the public, as the requirements in the rule are for the Government.
