DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement to implement section 345 of the National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2023 and section 333 of the NDAA for FY 2021. Section 345 of the NDAA for FY 2023 restricts DoD from procuring certain personal-protective firefighting equipment containing an intentionally added perfluoroalkyl or polyfluoroalkyl substance (PFAS), effective October 1, 2026. Section 333 of the NDAA for FY 2021 prohibits DoD from procuring any covered item that contains perfluorooctane sulfonate (PFOS) or perfluorooctanoic acid (PFOA) in covered items. Covered items are: (1) nonstick cookware or cooking utensils for use in galleys or dining facilities; and (2) upholstered furniture, carpets, and rugs that have been treated with stain-resistant coatings.
