DoD is withdrawing this rule, because implementation is no longer necessary in the Defense Federal Acquisition Regulation Supplement (DFARS) Executive Order (E.O.) 14275, Restoring Common Sense to Federal Procurement, and E.O. 14265, Modernizing Defense Acquisitions and Spurring Innovation in the Defense Industrial Base, which require reviewing and streamlining the FAR and DFARS, respectively.  Taken together, these efforts will streamline business practices, enabling DoD to deliver timely capabilities and lethality for our nation’s warfighters.  This rule would have removed coverage of the nonmanufacturer rule and added coverage of joint ventures in the clause at DFARS 252.219-7010, Notification of Competition Limited to Eligible 8(a) Participants Partnership Agreement. These revisions would have aligned with changes made in the final rule for FAR Case 2016-011, Revision of Limitations on Subcontracting (RIN 9000-AN35), and FAR Case 2017-019, Policy on Joint Ventures (RIN 9000-AN59).
