The Department of Defense (DoD) is proposing procedures for the dissemination and withholding of certain unclassified technical data and technology subject to the International Traffic in Arms Regulations and Export Control Reform Act Regulations consistent with the requirements of section 130 of title 10, United States Code. The rule will apply to DoD components, their contractors, and grantees and is meant to control the transfer of technical data and technology contributing to the military potential of any country or countries, groups, or individuals that could prove detrimental to U.S. national security or critical interests.  It also prescribes procedures for the Joint Certification Program Office; and clarifies specific requirements for the certification of DoD contractors and award recipients. This rule is being published as a second proposed rule to allow the public to comment on the responses made to the comments on the first proposed rule and the changes made to the regulatory text as a result.
