DoD published this part to revise its then-current policies concerning obtaining information from financial institutions under the Right to Financial Privacy Act of 1978, as amended (12 U.S.C. chapter 35). This part prescribes practices and procedures for DoD to obtain from a financial institution the financial records of its customers. The current rule conveys internal Department policy and implementation. This part will be revised to only include regulations relating to those instances when the Department submits "formal written requests" to financial institutions for customer records, as described by 12 U.S.C. 3408, and has been done by several other federal agencies. Cost savings have not been identified.
