This final rule will remove DoD’s regulation on State income tax withholding that covers uniformed Service members who are retired from the Military Services because it duplicates DoD’s internal policy. DoD will remove this part but is providing notice in the Federal Register on the day the final rule publishes to direct the public to internal policy in the DoD Financial Management Regulation and provide information on retired pay voluntary State tax withholding. The removal of 32 CFR part 278 supports a recommendation from the DoD Regulatory Reform Task Force.
