<p>The Department of Defense is modifying this final rule to comply with the requirements of Executive Order 14168, titled "Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government." This amendment removes the procedures for retirees, dependents, and contractor employees to request a change to their gender marker in the Defense Enrollment Eligibility Reporting System (DEERS) which was added to the CFR as part of a final rule (89 FR 11172-11198). Included in the final rule was a provision that allowed retirees, dependents, and contractor employees to request that their "gender marker&rdquo; be changed based on their preference.&nbsp; In accordance with Executive Order 14168, the Office of the Under Secretary of Defense for Personnel and Readiness is publishing an interim final rule to update DoD policy and the DEERS system to remove text that promotes or otherwise inculcates gender ideology. This amendment will conform the regulation by removing and replacing three instances of "gender&rdquo; with "sex&rdquo; and one instance of "gender marker&rdquo; with "sex code&rdquo;.&nbsp; Further, it removes the procedure for retirees, dependents, and contractor employees to elect to change this data in DEERS, absent an administrative error.</p>
