This proposed rule would modify the HIPAA Privacy Rule to require covered entities to treat as spouses the same-sex spouses of individuals whose marriage is legally valid in the State where it was celebrated for purposes of recognizing such persons as personal representatives of the individual under the HIPAA Privacy Rule.
