In March 2019, a recent order issued by the U.S. District Court for the Northern District of California (Order) vacated ONRR’s 2017 Repeal of its Consolidated Federal Oil & Gas and Federal & Indian Coal Valuation Reform rule (2017 Repeal rule, RIN 1012-AA20). By vacating the 2017 Repeal rule, the order reinstated ONRR’s 2016 Consolidated Federal Oil & Gas and Federal & Indian Coal Valuation Reform rule (RIN 1012-AA13), retroactive to its original effective date of January 1, 2017. Therefore, the Acting Deputy Secretary of U.S. Department of the Interior requested that ONRR immediately initiate a proposed rulemaking to address the regulatory impact of the recent court decision on mineral lessees. ONRR will publish a proposed rule to amend the existing regulations for valuing minerals produced from federally-administered mineral leases for royalty purposes and for issuing notices of non-compliance and assessing civil penalties.
