We received a petition to add all live amphibians or their eggs to our list of injurious wildlife under the Lacey Act unless certified as free of Batrachochytrium dendrobatidis (amphibian chytrid fungus). We are reviewing the comments received during the public comment period to determine whether to issue a proposed rule to list live amphibians or their eggs infected with chytrid fungus. This agenda item is being withdrawn at the present time to allow the Department to assess the action further and determine whether rulemaking is appropriate. Following such an assessment, the Department may determine that certain rules listed as withdrawn under this agenda are appropriate for promulgation. If that determination is made, such rules will be included in a succeeding semiannual agenda under new RINs.
