FWS proposes to change its regulations in response to mandates from Executive Order 13659, Streamlining the Export/Import Process for America's Businesses, and the Safe Port Act (Public Law 109-347), which lay out the implementation of the International Trade Data System (ITDS). The proposed rule will address changes in declaration requirements and exemptions for wildlife as defined under the Endangered Species Act, including changes needed to operate within the single-window environment of ITDS, which enables interfacing with other Federal inspection agencies. The proposal will also clarify prior notification requirements and clearance refusal options, and add the ability for FWS to offer a conditional release of certain wildlife in order to coordinate release activities under ITDS among agencies operating at the borders.
