As directed in Department of the Interior Secretary’s Order (SO) 3418, the Service will revise provisions of the 2024 final rule (89 FR 24300, April 5, 2024) that revised portions of 50 CFR part 424. The 2024 rule was promulgated jointly with the National Marine Fisheries Service of the National Oceanic and Atmospheric Administration; therefore, the proposed rule to revise the regulations in part 424 will require coordination with that agency. The resulting rulemaking action will clarify, interpret, and implement portions of section 4 of the Endangered Species Act concerning the procedures and criteria used for adding, removing, or reclassifying species on the Lists of Endangered and Threatened Wildlife and Plants and designating critical habitat.
