As directed in Department of the Interior Secretary’s Order (SO) 3418, the Service will revise provisions of the 2024 final rule (April 5, 2024; 89 FR 24268) that revised portions of 50 CFR part 402. The 2024 rule was promulgated jointly with the National Marine Fisheries Service; therefore, the proposed rule to revise the regulations in part 402 will require coordination with that agency. The resulting rulemaking action will clarify, interpret, and implement portions of section 7 of the Endangered Species Act concerning interagency cooperation procedures.
