As directed in Department of the Interior Secretary’s Order (SO) 3418, the Service will revise provisions of the 2024 final rule (89 FR 24268, April 5, 2024) that revised portions of 50 CFR part 402. The 2024 rule was promulgated jointly with the National Marine Fisheries Service of the National Oceanic and Atmospheric Administration; therefore, the proposed rule to revise the regulations in part 402 will require coordination with that agency. The resulting rulemaking action will clarify, interpret, and implement portions of section 7 of the Endangered Species Act concerning interagency cooperation procedures.
