This proposed rule would re-examine OSMRE’s regulation on ten-day notices that went into effect on December 24, 2020. The 2020 rule was intended to streamline our process for coordinating with regulatory authorities in order to minimize duplication of inspections, enforcement, and administration of SMCRA. Additionally, we proposed to enhance our procedures for early identification of, and implementation of corrective action to address, regulatory program issues.
