The regulations at 30 CFR 872.30 governed the distribution of prior balance replacement funds and the reallocation of funds available to eligible States and Tribes beginning in fiscal year 2035 and annually thereafter. Because the distribution of prior balance replacement funds is complete, the provisions related to those funds are unnecessary. Similarly, the regulations addressing future reallocations were duplicative and created confusion. Rescinding these regulations eliminates redundancy, improves clarity, and reduces burdens on State and Tribal grantees.
