As required by Executive Order (E.O.) 14270, Zero-Based Regulatory Budgeting to Unleash American Energy (April 9, 2025), and consistent with agency policy, the Office of Surface Mining Reclamation and Enforcement (OSMRE) is proposing to implement a program of zero-based regulating to periodically review many of its regulations (Zero-Based Regulating Rule). Specifically, the Department of the Interior (DOI) is proposing to amend existing regulations promulgated pursuant to the Surface Mining Control and Reclamation Act of 1977 (SMCRA or the Act) by inserting sunset provisions into various parts of 30 CFR Chapter VII to identify the circumstances under which a sunset date will be extended or the regulation allowed to expire and to require that sunset provisions in future regulations must be included in a new part - Part 708. For each relevant regulation in effect on the date the E.O. was issued, the sunset provision will establish a conditional sunset date of one year from the effective date of the final Zero-Based Regulating Rule. For each regulation promulgated after the final Zero-Based Regulating Rule, a sunset provision will be included that establishes a conditional sunset date of five years from the effective date of that new regulation, where applicable. If OSMRE does not extend a particular regulation before its conditional sunset date, that regulation will expire, cease to be enforceable, and be removed from the Code of Federal Regulations.
