The proposed rule implements provisions of the Hawaiian Home Lands Recovery Act, the State of Hawaii Admissions Act and the Hawaiian Homes Commission Act (HHCA). Part 47 describes the process for approving or disapproving land exchanges of Hawaiian home lands and the Department's responsibilities overseeing the Hawaiian home lands trust. Part 48 establishes the review and approval process for amendments to the HHCA by the State of Hawaii. The rules incorporate the results of discussions with the Native Hawaiian community and the State.
