The existing regulation (43 CFR 11) provides procedures that Natural Resource Trustees may use to evaluate the need for and means of restoring, replacing, or acquiring the equivalent of public natural resources that are injured or destroyed as a result of releases of hazardous substances. The Advance Notice of Proposed Rulemaking (ANPRM) would provide an opportunity for others (Federal Agencies, States, Indian Tribes, and interested public) to provide input on areas of the existing regulations that could be revised to increase effectiveness, efficiency, and restoration of the injured resources.
