This interim final rule revoked Department regulations issued during the prior Administration that prohibited (subject to limited exceptions), the inclusion of provisions in settlement agreements directing or providing for a payment or loan to a non-governmental person or entity that is not a party to the dispute. The Department's approach to settlement agreements that involve payments to non-governmental third partics is currently governed by an Attorney General Memorandum on this subject. The Department is reviewing comments on the IFR in preparation for drafting a final rule finalizing the IFR.
