        <ABSTRACT><![CDATA[Currently, access to the National Instant Criminal Background Check System (NICS) index for non-Brady Act reasons is limited to two purposes: 1) For the issuance of firearm-related or explosives-related permits or licenses and 2) to respond to Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) inquiries relating to the Gun Control Act or the National Firearms Act.  This rule amends FBI regulations to authorize criminal justice agencies to access the NICS Index to conduct background checks for the purpose of returning firearms in the possession of a law enforcement or criminal justice agency, including returning a firearm to a family member in suicide cases.]]></ABSTRACT>
