On October 12, 2023, the Department of Justice (Department) issued an interim final rule (IFR), 88 FR 70586, amending the regulations governing the Executive Office for Immigration Review's Office of the Chief Administrative Hearing Officer (OCAHO) to provide for administrative review of decisions and orders issued by OCAHO Administrative Law Judges (ALJs) in cases arising under section 274B of the Immigration and Nationality Act (INA or the Act), as amended, 8 U.S.C. 1324b, including the possibility for review by the Attorney General. The Department solicited public comment on the IFR, which the Department intends to consider and address in a final rule.
