The Older Americans Act Reauthorization Act of 2016 (2016 OAA) amended the statutory provisions authorizing SCSEP and required changes to SCSEP performance regulations by December 31, 2017. The Department of Labor issued an interim final rule (IFR) on December 1, 2017 (82 FR 56859) that made substantive revisions to 20 CFR part 641 subpart G (Performance Accountability) by implementing the amended SCSEP performance measures in OAA section 513, which in large part aligned the SCSEP performance measures with those mandated for the Workforce Innovation and Opportunity Act (WIOA) core programs under WIOA section 116.  The WIOA performance measures were implemented in a joint final rule issued by the Departments of Labor and Education on August 19, 2016 (81 FR 55792) and codified in 20 CFR part 677.  The IFR also made technical amendments to other subparts of 20 CFR 641 to reflect 2016 OAA amendments that aligned the SCSEP program statutory language with WIOA, such as updating outdated terminology and references to the Workforce Investment Act, which WIOA superseded.  The Department is in the process of analyzing the comments received and developing a final rule.
