<p>In 1995, the Department published an interpretive bulletin relating to the fiduciary standards under the Employee Retirement Income Security Act of 1974 (ERISA) when selecting an annuity provider for defined benefit pension plan distributions (IB 95-1).&nbsp; 60 FR 12329, amended at 73 FR 58445 (Oct. 7, 2008).&nbsp; Section 321 of the SECURE 2.0 Act of 2022 directed the Secretary of Labor, not later than I year after the date of enactment, to review IB 95-1, determine whether amendments are warranted, and report to Congress on the findings of such review, including an assessment of any risk to participants.&nbsp; The Department must consult with the Advisory Council on Employee Welfare and Pension Benefit Plans, established under ERISA section 512, as part of this review.</p>
