<p>In 1995, the Department published an interpretive bulletin relating to the fiduciary standards under the Employee Retirement Income Security Act of 1974 (ERISA) when selecting an annuity provider for defined benefit pension plan distributions (IB 95-1)<span class="gmail_default">,</span>&nbsp;60 FR 12329, amended at 73 FR 58445 (Oct. 7, 2008). &nbsp;Section 321 of the SECURE 2.0 Act of 2022 directed the Secretary of Labor, not later than I year after the date of enactment, to review IB 95-1, determine whether amendments are warranted, and report to Congress on the findings of such review, including an assessment of any risk to participants. &nbsp;As part of its review, the Department conducted more than 40 stakeholder meetings. The meeting participants included representatives of organized labor, employer groups, consumer groups, insurance companies, insurance trade associations, other regulators, consultants, academia, and other interested parties. A goal of the stakeholder outreach is to inform the report through meaningful and equitable opportunities for public input by a range of interested or affected parties, including underserved communities. The Department also consulted with the Advisory Council on Employee Welfare and Pension Benefit Plans, established under ERISA section 512, which held a public meeting on July 18, 2023, regarding the Interpretive Bulletin.</p>
