<p>The Maritime Advisory Committee for Occupational Safety and Health (MACOSH) was initially formed in 1995 as a discretionary committee of the Occupational Safety and Health Act of 1970 (OSH Act) to advise, consult with, and make recommendations to the Secretary of Labor on matters relating to the maritime industry.&nbsp; On December 20, 2019, the President signed into law the National Defense Authorization Act for FY 2020, Pub. L. 116-92, which contained provisions that amended the OSH Act (29 U.S.C. 656).&nbsp; Specifically, a new section 7(d) requires that a Maritime Advisory Committee on Occupational Safety and Health provide advice to the Secretary in formulating maritime industry standards and regarding matters pertaining to the administration of the OSH Act related to the maritime industry.&nbsp; The addition of section 7(d) to the OSH Act changes the characterization of MACOSH from a committee that is authorized by statute, to one that is required, making it non-discretionary.&nbsp; As such, it is necessary to amend the regulations affecting OSHA advisory committees (29 CFR part 1912), which this Direct Final Rule (DFR) accomplishes.</p>
