Section 7(i) of the Fair Labor Standard Act (FLSA) exempts certain commissioned employees at retail or service establishments from overtime requirements under the FLSA. Part 779 of title 29 Code of Federal Regulations contains the Department’s official interpretations of the statutory requirements for satisfying this exemption. The Department has not meaningfully updated these interpretations for many years. The Department proposes to revise these regulations.
