<p>The current regulations governing how the Office of Workers&rsquo; Compensation Programs (OWCP) administers the Energy Employees Occupational Illness Compensation Program Act of 2000, as amended (EEOICPA), 42 U.S.C. 7384 et seq., were last updated on February 8, 2019. &nbsp;On December 22, 2023, the National Defense Authorization Act for Fiscal Year 2024 was enacted as Public Law 118-31.&nbsp; Section 5501(b) of that statute amended section 7384l(8)(A) of EEOICPA to provide that beryllium sensitivity under Part B can now also be established by submitting three borderline beryllium lymphocyte proliferation tests performed on blood cells over a period of three years.&nbsp; This rulemaking updates multiple sections of the current regulations to incorporate this new entitlement provision</p>
