The Coast Guard is withdrawing the proposed rule titled "Assessment Framework and Organizational Restatement Regarding Preemption for Certain Regulations Issued by the Coast Guard,” which published in the Federal Register on December 27, 2013. The rule is unnecessary because Coast Guard determined that the implied and express preemptive effects of Coast Guard's regulations, as established in statutory authorities and case law, do not require a blanket, general restatement in the regulations of their preemptive effects. Instead, the Coast Guard will continue to address preemptive effect of particular rules in the preamble discussion of the rulemakings.
