This rulemaking proposes to create a new regulation requiring the submission of export manifest data electronically to U.S. Customs and Border Protection (CBP) in the Automated Commercial Environment (ACE) for cargo transported by rail pursuant to section 343(a), of the Trade Act of 2002, as amended (19 U.S.C. 1415), for any train departing the United States. The proposed regulation would mandate the electronic transmission of rail export manifest information, identify the parties eligible to transmit information, describe the time frames prior to departure of the train in which the information is due, and identify an initial filing that must occur 24 hours prior to departure from the port of export while requiring that remaining data be transmitted at least two hours prior to such departure.

For example, the Commercial Customs Operations Advisory Committee (COAC) is a Federal Advisory Committee whose quarterly meetings are open to the public. The COAC provides advice to the Secretary of the Department of Homeland Security, the Secretary of the Department of the Treasury (Treasury), and the Commissioner of U.S. Customs and Border Protection (CBP) on matters pertaining to the commercial operations of CBP and related functions within the Department of Homeland Security and Treasury. The public may provide comments/input during the meeting. One COAC working group is the Export Modernization Working Group (EMWG) which is specifically focused on the effects of progressive filing by the shipper to continuously update export information on successive dates, rather than filing on a specific date. In support of this effort, CBP has been conducting voluntary pilot programs since 2015 to allow participants to submit export manifest data to CBP electronically at least two hours prior to loading of the cargo onto the rail cars in preparation for departure from the United States. Further, CBP hosts the Trade Facilitation and Cargo Summits (TFCS) on a yearly basis which features CBP personnel, members of the trade community, and members of other government agencies in panel discussions on CBP's role in international trade initiatives and programs.
