This rulemaking amends the Department of Energy Acquisition Regulation (DEAR) to define management and operating contractor business systems as accounting systems, purchasing systems, earned value management systems, and property management systems. The rule amends part 970 DOE Management and Operating Contracts of the DEAR to implement compliance enforcement mechanisms in the form of a business systems clause and related clauses that allows contracting officers to reduce available fees, under certain conditions, when a contractor's business system contains significant deficiencies.
