10 CFR 1045 implements the Atomic Energy Act by establishing the requirements for the classification and declassification of Restricted Data (RD) and Formerly Restricted Data (FRD). 10 CFR 1045 is being revised to incorporate new responsibilities and policies for Transclassified Foreign Nuclear Information (TFNI), the return of FRD and TFNI to the RD category now permitted by amendment to the Atomic Energy Act, and marking requirements for portion marked documents containing RD/FRD/TFNI and National Security Information. Other updates include updating the challenge process, procedures for mandatory declassification review requests for documents containing RD, FRD and TFNI, and incorporating improvements to policies based on experience.
