        <ABSTRACT><![CDATA[NNSA Protective Force Officers (PFO) are granted arrest authority in section 161 (k) of the Atomic Energy Act (AEA), codified at 42 U.S.C. section 2201(k).  The DOE regulations that implement this CFR section of the AEA are contained in 10 CFR 1047.  Included in these regulations, at 10 CFR 1047.4, is a listing of a small subset of federal crimes for which PFOs have arrest authority.  The language of section 161(k) grants the Secretary the ability to modify the list of arrestable offenses included in 10 CFR 1047.4.   This list of offenses has not been amended since July of 1985.  Since that time, the climate in which NNSA operates has significantly changed due to the events of September 11, 2001.  It is critical that NNSA amend its regulations to adapt its operations to capture advantages learned from overseas, at other DOE/NNSA facilities, and through internal testing so that it can complete its mission of transporting nuclear weapons, nuclear weapons components and special nuclear material safely and securely.  There are no additional costs to DOE/NNSA, businesses or other governmental entities anticipated with making these revisions to 10 CFR 1047.4.]]></ABSTRACT>
