The Environmental Protection Agency proposes to establish new and revised human health water quality criteria for certain pollutants for the state of Alaska. On June 5, 2024, the EPA issued an Administrator’s Determination that Alaska’s human health criteria (HHC) are not protective of the state’s designated uses and that additional HHC are needed for certain toxic pollutants for which Alaska currently lacks any HHCCWA section 303(c)(4) requires the Administrator promptly prepare and publish proposed regulations setting forth new or revised WQS following a Determination that said WQS are necessary to meet the requirements of the CWA. In the June 5, 2024 Determination, the EPA stated that the Agency believes that 6-12 months is a reasonable timeframe to develop a NPRM. Based on this and the statutory language in CWA section 303(c)(4), the EPA is preparing to propose this rule by January 15, 2025 . to establish protective HHC for Alaska’s waters.
