<p>In 1990, the EPA promulgated regulations to supplement Title VI of the Clean Water Act (CWA) by codifying all major requirements applicable to the Clean Water State Revolving Fund (CWSRF) program. Since the release of the CWSRF regulations, Congress has made significant statutory amendments to the CWSRF program via the Water Resources Reform and Development Act (WRRDA) of 2014 and the Infrastructure Investments and Jobs Act (IIJA) of 2021. Such significant changes include expanding eligibility categories for CWSRF assistance; requiring loan recipients to prepare fiscal sustainability plans; using additional loan subsidies; developing affordability criteria; and increasing loan maturities to the lesser of 30 years or design life. This action would update the CWSRF regulations to align with these amendments as well as other Congressional amendments to the CWSRF program, and to reflect overall program policy changes that have occurred since 1990. The updates will assist state CWSRF managers and stakeholders by providing regulatory clarity through correction of current inconsistencies between CWSRF regulations and the implementing statute and program policies. Revising the CWSRF regulations will enable better training, consistent messaging of expectations, and more effective oversight of the program.</p>
