<p>On April 17, 2015, the Environmental Protection Agency (EPA) promulgated national minimum criteria for existing and new coal combustion residuals (CCR) landfills and existing and new CCR surface impoundments. On August 21, 2018, the D.C. Circuit Court of Appeals issued its opinion in the case of Utility Solid Waste Activities Group, et al v. EPA. In July 2018, EPA amended pieces of the 2015 final rule. Environmental groups challenged that rule and on March 13, 2019, the DC District Court allowed a voluntary remand without vacatur. In this rule, the EPA finalized a new cease receipt of waste deadline to replace the October 2020 date and addressed some issues from the August 2018 court decision. Additionally, the EPA finalized changes to the annual groundwater monitoring and corrective action report requirements and to the internet posting requirements, which were proposed in the August 14, 2019 rule entitled: Hazardous and Solid Waste Management System: Disposal of Coal Combustion Residuals from Electric Utilities; Enhancing Public Access to Information; Reconsideration of Beneficial Use Criteria and Piles.</p>
