        <RULE_TITLE>Reconsideration of the 2008 Ozone Primary and Secondary National Ambient Air Quality Standards</RULE_TITLE>
        <ABSTRACT><![CDATA[On March 12, 2008, EPA announced the final decision on the ozone national ambient air quality standards (NAAQS). Soon after that decision was signed on March 27, 2008 (73 FR 16436), the Clean Air Scientific Advisory Committee (CASAC) held an unsolicited public meeting and criticized EPA for setting primary and secondary standards that were not consistent with advice provided by the CASAC during review of the NAAQS. On July 25, 2008, several environmental and industry petitioners, as well as a number of States, sued EPA on the NAAQS decision, and the Court set a briefing schedule for the consolidated cases on December 23, 2008. On March 10, 2009, EPA requested that the Court vacate the briefing schedule and hold the consolidated cases in abeyance for 180 days. This request for extension was made to allow time for appropriate EPA officials appointed by the new Administration to determine whether the standards established in March 2008 should be maintained, modified, or otherwise reconsidered. Announcement of reconsideration of the March 2008 NAAQS decision occurred on September 16, 2009. The NAAQS proposal (including a proposal to stay implementation designations for the March 2008 NAAQS) was signed on January 6, 2010, with the final rule to be signed on or around October 2010. Reconsideration of the NAAQS will be limited to information and supporting documentation available to EPA and in the docket at the time of the March 2008 decision.]]></ABSTRACT>

As outlined in the abstract of this regulatory plan entry, this reconsideration is in response to actions by the courts regarding the last review in 2008.]]></STMT_OF_NEED>
            <LEGAL_BASIS><![CDATA[Section 109 of the Clean Air Act (42 U.S.C. 7409) directs the Administrator to propose and promulgate "primary" and "secondary" national ambient air quality standards for pollutants identified under section 108 (the "criteria" pollutants). The "primary" standards are established for the protection of public health, while "secondary" standards are to protect against public welfare.]]></LEGAL_BASIS>
            <ALTERNATIVES><![CDATA[The main alternatives for the Administrator's decision are whether to set different primary and secondary ozone standards than those set in 2008.]]></ALTERNATIVES>
            <COSTS_AND_BENEFITS><![CDATA[A supplement to the RIA was prepared that presents the costs and benefits associated with the proposed revised ozone standards.  This RIA was made available when the Notice of Proposed Rulemaking was published.]]></COSTS_AND_BENEFITS>
            <RISKS><![CDATA[The current national ambient air quality standards for ozone are intended to protect against public health risks associated with morbidity and/or premature mortality and public welfare risks associated with adverse vegetation and ecosystem effects. During the course of this review, risk assessments will be conducted to evaluate health and welfare risks associated with retention or revision of the ozone standards.]]></RISKS>
