This action is issuing an advanced notice of proposed rulemaking (ANPRM) to address some of the adverse comments EPA has received on the standards of performance for new stationary sources and emission guidelines for existing sources: other solid waste incineration (OSWI) units review proposed rule. EPA proposed the OSWI review rule on August 31st, 2020. EPA received significant public comments, including adverse comments from stakeholders. Some comments also raised complex technical issues, which would require EPA additional time to adequately evaluate certain sections of the rule in light of the comments received and determine an appropriate course for the OSWI regulation. After analyzing the complexity of the comments, the Court extended the final OSWI rule deadline to October 31st, 2021. The extension was granted to allow additional time for the Agency to complete that evaluation, review appropriate sections of the rules, and take supplemental actions if necessary. EPA has evaluated and analyzed all adverse comments and concluded that an ANPRM is the most efficient mechanism to gather data and public comment on potential necessary changes and address some specific adverse comments. EPA intends to issue an ANPRM prior to the promulgation of final OSWI rule in October 31, 2021.
