<p>This action will address the EPA&rsquo;s technology review of the National Perchloroethylene Air Emission Standards for Dry Cleaning Facilities (Perc Dry Cleaning NESHAP). The Perc Dry Cleaning NESHAP, 40 CFR part 63, subpart M, was promulgated pursuant to section 112(d) of the Clean Air Act (CAA) on September 22, 1993 (58 FR 49354). EPA then conducted a residual risk and technology review on July 27, 2006 (71 FR 42724). The Perc Dry Cleaning NESHAP contains maximum achievable control technology (MACT) standards for major sources and generally available control technology (GACT) standards for area sources. This action will implement the technology review requirements of CAA section 112(d)(6). CAA section 112(d)(6) requires the EPA to review and revise the standards as necessary, taking into account developments in practices, processes and control technologies, no less often than every 8 years. A consent decree requires EPA to sign a proposal for this NESHAP by December 1, 2021, and to sign a final rule by December 1, 2022. In addition, this action may address the agency&rsquo;s review of the New Source Performance Standards (NSPS) for Petroleum Dry Cleaners. The Petroleum Dry Cleaners NSPS, 40 CFR part 60, subpart JJJ, was promulgated pursuant to section 111(b) of the CAA on September 21, 1984 (49 FR 37328) and was last amended on October 17, 2000 (65 FR 61744). The NSPS established standards of performance in the form of emission limitations and/or work practice requirements based on the best system of emission reductions (BSER), taking into account the cost of achieving such reduction and any non-air quality health and environmental impact and energy requirements. This action may implement the review requirements of CAA section 111(b)(1)(B). CAA section 111(b)(1)(B) requires EPA to review, and if appropriate, revise the standards of performance based on the BSER, no less often than every 8 years. There is no court-ordered deadline for the NSPS review.</p>
