<p>This action will address the EPA&rsquo;s technology review of the National Perchloroethylene Air Emission Standards for Dry Cleaning Facilities, the Perc Dry Cleaning National Emission Standards for Hazardous Air Pollutants (NESHAP). The Perc Dry Cleaning NESHAP, 40 CFR part 63, subpart M, was promulgated pursuant to section 112(d) of the Clean Air Act (CAA) on September 22, 1993 (58 FR 49354). EPA then conducted a residual risk and technology review on July 27, 2006 (71 FR 42724). The Perc Dry Cleaning NESHAP established maximum achievable control technology (MACT) standards for major sources and generally available control technology (GACT) standards for area sources. This action will implement the technology review requirements of CAA section 112(d)(6). CAA section 112(d)(6) requires the EPA to review and revise the standards as necessary (taking into account developments in practices, processes and control technologies), no less often than every 8 years. The EPA published a proposed rule for this action on December 27, 2021 (86 FR 73207), and a correction to the proposed rule on January 5, 2022 (87 FR 421). EPA proposed to require existing machines to have both refrigerated condensers and carbon adsorbers as secondary controls. A consent decree requires EPA to sign a final rule for this NESHAP by February 1, 2024</p>
